Hosting Suspension & Restoration Terms
General operating terms for temporarily suspending and restoring Denton BBQ-managed hosted services.
1. Scope
These terms apply to websites, portals, applications, and related services hosted or managed by Denton BBQ LLC when the applicable client agreement does not provide different suspension terms. A signed proposal, Statement of Work, hosting agreement, or other client-specific written agreement controls if it conflicts with these terms.
2. Suspension for Nonpayment or Material Breach
When a hosting, maintenance, subscription, recurring-service, project, or other applicable charge remains unpaid beyond the overdue period stated in the applicable agreement or invoice terms, Denton BBQ LLC may temporarily suspend public access to the affected hosted service. Denton BBQ may also suspend access when reasonably necessary to address a material contract breach, security threat, unlawful use, provider requirement, or risk to other systems. Denton BBQ will use reasonable efforts to provide notice before suspension when circumstances permit.
3. Temporary Public Notice
During a suspension, Denton BBQ LLC may replace the normal public website, portal, or application interface with a neutral temporary-service notice such as “This website is temporarily unavailable. Please check back soon.” Denton BBQ will not publicly identify nonpayment, a billing dispute, or another private account reason on that notice unless the client specifically authorizes such disclosure in writing or disclosure is legally required.
4. Infrastructure and Data During Suspension
A suspension is intended to restrict public access, not to delete the client’s hosted data or terminate the underlying deployment. Unless a separate agreement or security condition requires otherwise, Denton BBQ may keep the hosting project, database, files, integrations, backups, DNS configuration, and related infrastructure in place while access is suspended. Continued third-party infrastructure costs may remain billable when allowed by the applicable agreement.
5. Restoration
Denton BBQ LLC may restore public access after the condition causing suspension has been resolved, including receipt or confirmation of required payment, cure of the applicable breach, or completion of necessary security work. Restoration is normally performed without changing the client’s domain or rebuilding the hosted service, but reasonable processing, verification, deployment, DNS, or third-party-provider time may be required.
6. Temporary Service Response
Where technically practical, a suspended public website may return an HTTP 503 Service Unavailable response so browsers and search engines are informed that the interruption is temporary. Denton BBQ may keep selected administrative, health-check, webhook, integration, or infrastructure endpoints available when needed to operate, secure, restore, or support the service.
7. No Waiver or Termination by Suspension Alone
Temporary suspension does not by itself waive outstanding charges, modify payment obligations, transfer ownership, or terminate the client relationship. Termination, transition, data export, and decommissioning remain governed by the applicable client agreement and Denton BBQ’s other published service terms.
